SALIENT POSITION DETAILS

A reputed and large Real-Estate group in the UAE, with major projects coming up across the Northern Emirates, is looking for this position, the main shortlist criteria are as below

1.    Applicant must be currently handling litigations of a major real-estate company in the UAE and has 8-10 years of prior experience in a similar position.
2.    His main job responsibility will be to manage all the litigation work related to lawsuits filed against the company and the lawsuits filed by the company.
3.    Must be a native Arabic speaker with excellent command of English.


SALARY AND EMOLUMENTS


The employer is targeting a salary of around AED 25,000/- per month + Benefits, Incentives and Expenses.
Higher package / negotiations are possible for the right person for this Role.


DETAILED JOB RESPONSIBILITIES

1.    Effective and efficient management of Lawsuits and Claims filed by and/or against the Company.
2.    Continuously monitor Lawsuits and Claims with statutory obligations and advise management accordingly.
3.    Provision of legal advisory services and ensuring effective management of Lawsuits and Claims risks.
4.    Completes routine tasks and lead the legal work, including research, court filings and AHRED’s client communication.
5.    In the pre-trial stage, consults with and advise clients; retain expert witnesses; attend pre-trial conferences and develop a trial strategy based on the facts and evidence.
6.    Conducts an initial case investigation to determine, in the plaintiff’s case, if enough evidence exists to file a lawsuit or, in the defendant’s case, what evidence exists to defend a potential suit. The investigation process may include locating witnesses, taking witness statements, gathering documents, interviewing, and investigating the facts leading to the dispute.
7.     Employs a variety of discovery devices to gain information relevant to the lawsuit. These devices include interrogatories, depositions, requests for production and requests for admission.
8.    Is engaged in pre-litigation settlement discussions to resolve the matter before a lawsuit is filed.
9.    At settlement, is engaged in negotiations with opposing parties; participate in mediations and settlement conferences with the parties and the judge; and create settlement brochures, agreements, releases, and other settlement materials.
10.    Reviews and drafts Summons, Pleas and Memorandums and ensure that they are in accordance with all statutory or legal requirements.
11.    At trial, conducts voir dire and present our case in court.
12.    Presents opening and closing statements, examine and cross-examine witnesses and craft a persuasive story for the factfinder (judge) through testimony and evidence.
13.    Drafts and argue discovery-related motions including motions to compel, protective orders and summary judgment motions.
14.    Presents our case before the judge or preparing for the next day in court. In the trial stage of litigation, will craft a trial theme, identify strengths and weaknesses in a case; develop persuasive arguments; prepare witnesses for testimony and draft and argue trial motions.
15.    Drafts post-trial motions; identify and preserve issues for appeal; develop appellate strategies; gather evidence for the appellate record; research procedural issues; draft appellate documents, and present oral arguments before appellate courts.
16.    Provides legal protection and risk management advice to management especially on Lawsuits management.
17.    Consults with relevant departments to ensure that where legal risks have been identified, appropriate courses of action have been taken.
18.    Provides independent advice (orally and in writing) to top-level management on highly technical matters.
19.    Proofreading and editing final translated versions.
20.    Formulates/improves checklists to be used for the purpose of ensuring that all information required is provided accordingly and on time.
21.    Prepares monthly and quarterly reports for the department for executive management meetings.
22.    Requires thorough knowledge of the organization's products/services.
23.    Provides and interpret legal information, conduct, and disseminate appropriate legal requirements to staff.
24.    Conducts the appropriate discussion with AHRED’s clients about any unclear points and answering their questions.
25.    Performs a variety of tasks. Leads and directs the work of others. Provides guidance and advice to a staff of paralegals or legal assistants involved in prosecuting or defending lawsuits.
26.    Manages work schedules to meet deadlines; and
27.    What may be added to the above at the request of the manager in charge.

•    Lawsuits and Claims (Civil and/or Criminal) management - 50%
•    Regulatory support (Negotiations about legal disputes either Civil or Criminal) - 20%
•    Risk management - 15%
•    People management - 15%

EDUCATION


•    Graduate – Law Degree.
•    Relevant Experience
•    Eight (8) years and above of litigation experience.

•    Legal capabilities.
•    Excellent research skills.
•    Familiar with standard concepts, practices, and procedures within real estate/ hospitality/ construction fields.
•    Proven ability to delicately solve sensitive matters.
•    Using appropriate software for presentation and delivery.
•    Strong Communication Skills.

COMPUTER SKILLS

•    Excellent command of Word, Excel, PowerPoint etc.
•    Proficiency in MS office and internet use.

LANGUAGE ABILITY

•    Speak, read, and write fluently in Arabic is necessary; English is required.
